TERMS & CONDITIONS OF SALE APPLICATION OF CONDITIONS
The following terms and conditions shall apply to the sale and supply of all goods and services by BCT Outdoors Limited (hereafter referred to as the BCT
Outdoors). The customer refers to the person or organisation who agrees to purchase the goods from BCT Outdoors. No variations sent by the customer shall
be binding on the company unless agreed in writing under the hand of a director of the company.
DELIVERY
BCT Outdoors will use its best endeavours to despatch the goods ordered within the time periods advised but will not be responsible for any losses incurred
by the customer or third parties as a result of late delivery. BCT Outdoors will also endeavour to deliver goods ordered simultaneously in one consignment
but in the event of part delivery the customer will not be entitled to repudiate the agreement or refuse to accept the delivery of the part delivered nor to refuse
nor withhold payments of goods delivered.
NOTIFICATION OF DAMAGE
The customer shall be responsible for inspecting the goods on delivery and shall endorse at the time of delivery the carrier’s documents with details of all the goods found to be damaged or faulty. The customer shall also notify BCT Outdoors immediately and give written confirmation within 48 hours. Any claims
not so recorded will not be credited or claimed.
CANCELLATIONS
The cancellation of orders for standard products will not be accepted without written consent first being given by BCT Outdoors. If the company agrees to
accept the return of any goods such agreement is subject to the goods being fit for sale in their original packing and in such condition that they can be re-sold
at their full current price by as charged by BCT Outdoors. BCT Outdoors shall be entitled to raise and if so the customer shall pay a handling charge in respect
of the administration of the cancelled order.
RETURNS
BCT Outdoors will not accept the return of any goods unless such return has received prior approval of BCT Outdoors.
FAULTY GOODS
Only goods which can be proven faulty in that they result from faulty manufacture and are outside the accepted standard tolerance and specification and cannot
be economically repaired will be credited their full invoice price. Damage to the packing of the product does not constitute a product failure or fault and such
goods will not be credited nor accepted.
PRICE
The Price shall be that on BCT Outdoor’s current list price, web site, or if applicable the price contained in the sales quotation. Should a product’s price
change between receipt of order and dispatch the customer will be notified and given the opportunity to cancel the order and receive a full refund. Unless
stated otherwise all prices are exclusive of VAT and charges for packing, postage and carriage (plus VAT) and shall be paid in addition. The total purchase
price, including VAT and delivery charges will be displayed on the customer’s sales order confirmation.
RETENTION OF TITLE
The goods shall remain the property of BCT Outdoors until the customer pays their price in full.
FORCE MAJEURE
In the event that BCT Outdoors is prevented from carrying out the obligation of the order as a result of any cause beyond its control such as but not limited to
Acts of God, War, Strikes, Lock-outs, Flood and Failure of third parties to deliver goods, BCT Outdoors shall be relieved of its obligations and liabilities under
such contract for sale for as long as such fulfilment is prevented.
LIABILITY
BCT Outdoors will only be liable to replace any goods shown to have been damaged through their neglect or accepted by the manufacturer as being faulty.
BCT Outdoors will under no circumstances whatsoever be responsible or liable for any consequential losses incurred by the customer or any third party.
